DailyMed Terms and Conditions

These terms govern the use of en.fajasdailymed.com and DailyMed's wholesale business relationships, including quotations, orders, production, private label, payments and exports.

1. Identity, scope and B2B model

DailyMed is a brand owned by V3MARKETING S.A.S. The website is primarily intended for distributors, wholesalers, clinics, boutiques, professionals and private-label brands of different sizes.

DailyMed does not currently operate as a regular retail store. Single-unit purchases are generally limited to samples for commercial evaluation. The subsequent use of the products is at the buyer's discretion, and the buyer must comply with the regulations of its market.

2. Quotation, acceptance and communications

  • Full or partial payment constitutes acceptance of the final quotation, these terms and the approved specifications.
  • Specific terms written in a quotation, order, NDA or other specific agreement prevail over these general terms.
  • Approvals and changes made by email or WhatsApp constitute valid written communications.
  • When a change is approved, the updated version of the order replaces the previous specifications.
  • Billing and export details are taken from the new client form. They may be corrected free of charge before dispatch; once customs documents have been issued and used, changes may no longer be possible.

3. Minimum orders, prices and quotations

3.1. Regular minimum order

  • 40 units per reference and color.
  • 5 units per size, always in multiples of five.
  • PM: 40–79 units; MM: 80–159 units; MPRO: 160 units or more.

Products available in inventory may allow more flexible quantities, solely subject to availability and approval by a sales advisor.

Additional private-label services, such as custom labels, bags or packaging, may require minimum quantities of approximately 100 to 500 units depending on the item.

3.2. Prices

Export prices are normally stated in U.S. dollars (USD) and cover the product. Freight, insurance or handling, customization, payment fees, taxes, duties, customs clearance and destination charges are added when applicable.

Sales within Colombia require a specific price list and terms supplied by an advisor. A product quotation is valid for 30 days; freight is confirmed on the dispatch date.

International invoices are issued in USD unless otherwise requested. Even if a bank or payment gateway processes another currency, the buyer must cover the full net USD equivalent stated in the quotation.

4. Payments and confirmation

4.1. Production orders

A 50% deposit is required to begin production. Once the merchandise is finished and packed, the remaining 50% plus final freight must be paid. Dispatch takes place after full net payment has been verified.

4.2. Inventory products

100% of the product and applicable transportation must be paid before dispatch.

4.3. Payment methods

  • Preferred method: international bank transfer directly to V3MARKETING S.A.S.
  • The buyer is responsible for bank and intermediary fees, normally between USD 20 and USD 30.
  • Cards may be accepted for small payments, subject to an additional 3% fee.
  • Western Union and methods that do not properly identify the payer and exporting company are not accepted.

Payment is complete only when V3MARKETING S.A.S. receives the full net amount.

4.4. Cancellation and refund of payments

Before a transfer is accepted or credited, the buyer may request that it not be completed. After funds are credited, any refund is calculated after deducting exclusive materials, fees, currency conversion, preparation and all other actual, non-recoverable costs incurred. Any unused balance will be returned.

5. Production, lead times and changes

  • Regular production: approximately 20–30 calendar days.
  • First order with branded elements: approximately 30–40 calendar days.
  • Express production for first orders: may be ready in approximately one week, at no extra charge, subject to capacity and approval.

Lead times begin when the deposit is confirmed. Quantities, sizes, colors, references, designs and materials must be defined and approved by that time.

Later changes are not guaranteed. DailyMed will assess feasibility and may adjust costs or dates. No fabric, accessory, packaging or other input will be replaced without the client's prior approval.

Lead times are estimates. Express production is a support option for new clients, not an automatic delivery promise.

6. Private label, samples and intellectual property

The client represents that it owns all necessary rights or authorizations for the names, trademarks, logos, designs and files supplied. DailyMed performs a preliminary good-faith web review, but this does not replace a professional trademark search. If inconsistencies arise, the order may be suspended or rejected.

DailyMed will not publish photographs, videos or customized products bearing the client's brand without prior express authorization.

Samples are governed by the DailyMed Samples Policy. They are non-returnable. DailyMed does not charge separate development fees: each prototype is charged at the lowest available wholesale price for the garment.

If a new sample is required because of a defect attributable to DailyMed, DailyMed will cover the correction. If it results from ordinary pattern adjustments, adding or removing elements, or new client preferences, the client pays for the new sample, materials and shipping.

7. Exclusivity for custom developments

7.1. Development created by DailyMed

Each product developed specifically for a client receives, at no additional cost, five years of commercial exclusivity in the agreed destination country. A territorial extension may be requested at info@fajasdailymed.com; requests are normally answered within 48 hours.

Exclusivity may end if any of the following occurs:

  • No orders are placed during the first three months.
  • Purchases of the product do not exceed 250 units during the first year.
  • Six consecutive months pass without an order for that reference.

At the end of the five-year term, exclusivity may be renewed if at least 250 units are purchased annually and no more than six consecutive months pass without orders.

7.2. Final pattern supplied by the client

When the client directly supplies its own final pattern—not a photograph, reference or idea—DailyMed will maintain permanent exclusivity and will not use it for third parties. Before delivering it, the client must request an NDA at info@fajasdailymed.com.

8. International shipping, insurance and customs

DHL is the primary carrier. Depending on the destination and convenience, FedEx or airlines may also be used. The usual term is DAP – Incoterms® 2020 to the address stated in the quotation, although other terms may be agreed in writing.

DailyMed arranges and insures transportation for the invoiced value of the merchandise to the agreed delivery location. The buyer acts as importer and is responsible for permits, registrations, classification, customs clearance, duties, taxes and procedures in the destination country.

If the carrier confirms a loss, the recognized insurance compensation will be used to reproduce the lost merchandise. Timing will depend on the claim and the new production cycle.

If the buyer fails to provide documents, pay taxes or clear the merchandise through customs, the buyer assumes storage, return, abandonment, destruction, return transportation and any subsequent reshipment.

As a reference, one shapewear garment weighs approximately 300–350 grams, and DHL may apply an initial handling charge of approximately USD 45 plus the per-kilogram rate. Values change daily according to market conditions, fuel, currency, route, contingencies and carrier. DailyMed does not add a margin to freight; the final amount is calculated on the dispatch date.

9. Final payment, storage and abandonment

Once notified that the order is complete, the buyer has 14 calendar days to pay the balance and transportation. After that period, storage will be charged at USD 10 per cubic meter per day.

The general maximum unpaid storage period is two months unless otherwise agreed in writing. If that period expires without payment, response or agreement, the order will be considered abandoned. The client loses the right to a refund or claim to the merchandise, and DailyMed may remove labels, packaging and branded materials to sell the garments as clearance stock and mitigate losses.

10. Product information, tolerances and conformity

Photographs and colors may vary because of screens, lighting and production lots. The following are considered ordinary tolerances for stretch garments:

  • Up to ±1.5 cm in unstretched linear measurements.
  • Up to ±1 cm in the placement of labels, logos or applied elements.
  • Minor variations in shade, texture or perceived compression inherent to materials and production lots.

These tolerances do not cover errors in reference, size, color or construction. For customized products, the approved sample, technical specification and written agreements prevail.

11. Website use and intellectual property

Texts, photographs, catalogs, tables, designs, logos, code and all other content are owned by V3MARKETING S.A.S. or used with authorization. They may not be copied, extracted, distributed or commercially exploited without written permission.

Interfering with website security, automating abusive extraction, impersonating others, introducing malicious code or using forms for fraudulent purposes is prohibited.

Third-party links are provided to facilitate payments, messaging, analytics or logistics. Those services are also governed by their own terms and policies.

12. Regulatory classification, liability and force majeure

Products are generally marketed as control, compression and support garments. Their classification may vary by country. The buyer must verify requirements, permits, registrations, labeling and restrictions before importing or marketing them.

Information about post-surgical use is general and does not replace the evaluation, diagnosis or direction of a healthcare professional. DailyMed does not guarantee identical body results for every person.

To the fullest extent permitted by law, DailyMed's financial liability is limited to the amount actually paid for the products directly related to the claim. Indirect loss, lost profits, lost sales and reputational damage are excluded unless mandatory law provides otherwise.

Lead times may be extended because of material shortages, customs closures, strikes, disasters, war, carrier failures, government action or other events beyond DailyMed's reasonable control. Affected clients will be informed and commercial solutions may be proposed to mitigate the impact.

13. Governing law, disputes, language and changes

These terms are governed by the laws of Colombia. The parties will attempt to resolve any dispute through direct negotiation for 30 calendar days by writing to info@fajasdailymed.com. If no agreement is reached, the authorities and courts of Medellín, Antioquia, will have jurisdiction, without prejudice to any applicable mandatory rules.

The primary legal version is the version published in Spanish. English and Arabic versions are provided for international clients. A specific agreement may state that its English version prevails for that transaction.

Each order is governed by the version available when payment is confirmed, together with any later changes approved in writing. DailyMed may update these terms for future transactions.
